Signing up takes a web page. Leaving takes a negotiation. Unless you live in New York.
A New York court found that SiriusXM’s cancellation process was unlawfully harder to use than its signup, because cancelling required a live agent trained to present several retention offers first. The ruling was unanimously affirmed on appeal. After it, SiriusXM opened an agent-free online cancellation path for New York residents who bought online. Whether customers elsewhere can now cancel online without an agent is not established.1,2,12
The offer count is a court finding from SiriusXM’s own training material. The cancellation times are SiriusXM data cited by the New York Attorney General from the period it investigated; they are not current averages.1,15
Starting to pay is self-service. Stopping was a conversation.
It was undisputed in court that customers could subscribe without interacting with a live agent but had to interact with one to cancel. The court added the “inevitable wait times” of a live channel and the offers made before cancelling, and concluded the cancellation procedure was “clearly not as easy to use as the initiation method.”1

Historical and current. The cancellation column describes the process the court reviewed. Today, New York residents who bought online can cancel online without an agent (section 05). SiriusXM’s customer agreement, last updated 5 June 2025, still names phone and online chat as the channels for direct-billed subscriptions.8,13
What happened after a customer said “cancel”.
The sequence below comes from the court record, which quotes SiriusXM’s own training material. It is not a reconstruction from customer complaints. The appellate court summarized it as a “multi-tiered script, multiple save offers, and pressure tactics to opt into a new plan.”1,2

Instructions that favoured the customer
Retention-linked pay, with safeguards
The Attorney General argued agents were incentivized partly on how many cancelling subscribers they retained. The court said incentives tied to retention “certainly” had the potential to create an atmosphere conducive to fraud, but found SiriusXM had taken “repeated steps to avoid creating such an atmosphere.”1
SiriusXM’s explanation. SiriusXM told the court that many customers who call to cancel are “in reality looking to get a discount on their service”, and that agents are directed to respond by offering deals before cancelling.1
The friction in numbers, from the period the court reviewed.
These are the strongest numbers available, and none of them is current. The timing data is SiriusXM’s own, as cited by the Attorney General for the period it investigated, principally 2019–2021. No current national average has been published.1,15
SiriusXM’s counter-figure. SiriusXM said that in 2021 its online chat agents responded to consumer messages within 36 seconds to 2.4 minutes on average.15
Unlawful friction, three times in court. Fraud, never found.
The federal Restore Online Shoppers’ Confidence Act (ROSCA) requires a “simple mechanism” to stop recurring charges for subscriptions sold online. A New York court held that SiriusXM’s process failed that test, an appellate panel agreed unanimously, and an injunction followed.1,2,3
21 November 2024
ROSCA Violated · summary judgment for the StateCancelling was “clearly not as easy to use as the initiation method”, and the number of save offers caused “unreasonable delay”. ROSCA’s “simple” standard was held not unconstitutionally vague.1

Enjoined For New York online purchasersSiriusXM may not give those consumers a cancellation method using a multi-tiered script, multiple save offers and pressure tactics. It must account for New York online purchasers from 1 Jan 2019 to 27 Nov 2024, including cancellation attempts and charges. Damages remain outstanding.3
Four of the Attorney General’s five claims failed, including fraud under Executive Law §63(12), deceptive practices under GBL §349 and New York’s automatic-renewal statute. Customers had been told when signing up that they must contact SiriusXM to cancel, so the process was, in the trial court’s words, “frustrating, but it is not deceptive.” CHI’s finding rests on the ROSCA holding alone.1,2
SiriusXM’s position. After the trial ruling SiriusXM said the court “did not find that SiriusXM ever deceived anyone or committed any fraud” and called the violations “technical”. In its filings it says it has substantial defences.13,16 Out-of-state reach. The courts held the Attorney General cannot recover for consumers outside New York, whose calls were handled by agents in the Philippines. That question is now before the Court of Appeals.2,4
Same company, same product, same goal. A different exit where a court required it.
SiriusXM’s own SEC filings confirm the difference. “As a result of the Court’s findings, we now permit New York residents who purchase a subscription online to also cancel that subscription online.”12
Agent-free online cancellation
Phone or online chat
- “All Subscriptions may be cancelled by phone or online chat”; other means “where required by law”Customer agreement, last updated 5 Jun 20258
- Agent interaction remains built into both channels
- The public help page also lists the Online Account Center’s Subscriptions tab, with no state namedHelp page, read 12 Oct 20269
The contract and the SEC filings describe online cancellation as a New York accommodation; the help page suggests a broader online option. CHI did not test a logged-in cancellation from any state, so it does not know what the Subscriptions tab does for a non-New-York satellite subscriber. This page does not claim that customers outside New York must call.
The federal backstop that did not arrive. After the trial ruling SiriusXM said it would abide by the FTC’s “click to cancel” rule.16 The Eighth Circuit vacated that rule on 8 July 2025, before it took full effect; the FTC has since begun a new rulemaking, according to law-firm reports.18,19
The two doors, side by side.
The cancellation channel is also a pricing channel.
The discounts are delivered at the exit. SiriusXM’s defence in court was that many people who say “cancel” want a better price, and its agents respond with deals. A customer who never asks to leave never reaches that conversation.1
The $4–$8 range is not a published SiriusXM price. It is a pattern repeated across years of customer forum reports; offers vary by customer and are not universally available.
SiriusXM 2025 annual report (Form 10-K), risk factors. The same passage says a substantial percentage of subscribers are on promotional plans, that SiriusXM has historically been unsuccessful in moving many of them to higher-priced plans, and that many cancel when offered a higher price.12
Passive customer
Lets the plan renew. The customer agreement allows renewal “at the rates in effect at the time of each renewal”; cancelling must happen at least 24 hours before the renewal date.8
Active customer
Threatens to leave, sits through the offers, and may receive a substantial discount. The cancellation gate is also a price-discrimination mechanism.
Price discrimination by tolerance for hassle.
The same gate sorts customers into three groups. Customers willing to endure the cancellation interaction can obtain better economics. Customers who do nothing remain at materially higher renewal prices. That monetizes differences in attention, persistence, willingness to negotiate and tolerance for hassle.

An analytical finding, not a new Lexicon category. It is related to the Lexicon entry Exit Resistance. Other inertia mechanics in SiriusXM’s terms: selling or trading in a vehicle, or not using the service, does not cancel a subscription.8
More than a decade of regulatory attention to the same exit.
In 2014 SiriusXM agreed with 45 states and the District of Columbia to make cancelling easier. In 2024 a New York court found its cancellation process unlawfully harder than signup.6,1

Old numbers, untested flows
- The timing metrics are historical, not current.
- The current nationwide logged-in cancellation flow was not tested.
- Record-low churn of about 1.4% in Q2 2026 has other stated causes, including continuous service and lower vehicle-related churn, and cannot be attributed to cancellation friction alone.14

About intent and conduct
- That SiriusXM intended to deceive customers.
- That employees were told to refuse legitimate cancellation requests.
- That billing after cancellation is systematic. It is alleged in some consumer accounts, not found.
- Whether all non-New-York customers can now cancel self-service online.
- Whether the 578,000 callers who abandoned the queue stayed subscribed and kept paying.

Final CHI assessment · Supports
SiriusXM turned cancellation into a pricing desk.
SiriusXM’s cancellation friction was not inferred from customer annoyance alone. A court found the process unlawfully harder than signup, SiriusXM’s own training material documented a multi-offer retention architecture, and the company created an agent-free alternative when compelled to do so in New York.
Customers willing to negotiate could receive substantial discounts. Customers who persisted could leave. Customers who did neither remained on ordinary renewal economics. That makes the friction economically meaningful, even though the available evidence does not quantify its revenue contribution.
The verdict concerns SiriusXM’s cancellation and retention architecture. It is not a finding that SiriusXM committed fraud. No numerical CHI, CVI or CFS score has been assigned.
SiriusXM made subscribing self-service,
but historically made cancelling a negotiation.

Limits carried onto this page. CHI did not open an account, so neither the signup flow nor the cancellation flow was walked through, in New York or elsewhere, and no screen or click counts are given. The cancellation times and the 578,000 figure are from the Attorney General’s petition as reported, based on SiriusXM data from the period investigated. Retention prices come from customer reports, not SiriusXM. A September 2026 analysis of app-store reviews found recurring reports of chat-based retention and of charges after cancelling20; CHI treats these as patterns only.
