Executive verdict

One of the strongest customer-value systems in the corpus, and one of the most documented control cases in it.

Tesla is not a company that took a great deal of money for very little. It is a company that delivers unusually high value and retains unusually high control over that value after the sale. CHI scores those two facts on separate axes because they are separately true.

Customer Favorability Score

+13 is not mediocrity. It is a very large positive and a very large negative netting out.

CFS is CVI minus CHI: 81 − 68 = +13, which falls in the Finely Balanced band. Read carelessly, that number suggests a company of middling consequence in both directions. Tesla is the opposite — it sits near the top of the corpus on delivered value and near the top on documented control, and the two figures happen to be close.

Why the value score is high

CVI 81 rests on things that are measurable and independently verified rather than claimed: the charging network’s five-year run at the top of J.D. Power’s DC fast-charging rankings, crash results from three separate regimes, the lowest ten-year running cost of any brand in Consumer Reports’ member data, winter range retention corroborated by independent fleet telemetry, and a decade of free capability delivered to cars already sold.

It is not higher because several value pillars measurably degraded between 2023 and 2026 — resale value above all — and because the reliability and service record, though improving, remains the weakest part of the proposition.

Why the hostility score is also high

CHI 68 is not built from fees. Tesla runs no advertising in its products, sells no customer data, and posts one national price. The score is built almost entirely from representation and control: capability sold before it existed, a product that can be altered after delivery through a channel the owner cannot refuse, remedies withdrawn without announcement, and a forum in which most claims are resolved invisibly.

It is not higher because the corrections are real where they landed, the clean extraction surface is genuine, and the strongest adverse representation finding is contested in court rather than settled.

01 · Promissory Product Monetization

Full Self-Driving is the clearest case on the index of selling a capability before it existed.

From October 2016 Tesla sold Full Self-Driving at prices laddered from $3,000 to $15,000, under messaging that the price would rise as delivery approached.S72S1 The launch demonstration video was staged — established by the sworn testimony of Tesla’s own Autopilot software director.S39 Hardware sufficiency was represented across three generations; in January 2025 the chief executive conceded that HW3 cars, roughly four million of them, cannot deliver the product, and as of the July 2026 earnings call the free upgrade promised in its place had no programme, timeline or cost.S77S76 No refund policy has ever existed. The refunds that exist were won one at a time, in arbitration and small-claims actionsS89S87 — and a remedy a single customer can win is not a remedy the company offers. That distinction carries more weight here than anywhere else on the page: each win shows the claim had merit, and shows that no general remedy was available.

In December 2025 the California DMV adopted a finding that the marketing was “actually, unambiguously false.” Tesla complied in February 2026 and sued to erase the finding, which is therefore contested rather than settled — and is a state administrative adjudication, not a fraud judgment.S15S78 In the same month the option to buy FSD outright was eliminated in North America, leaving prior purchasers on a discontinued product.S71

02 · Digitally Contingent Ownership

What a Tesla is depends on permission Tesla can withdraw.

Battery capacity, acceleration, lane centering and network access are software states rather than fixed properties of the object. Tesla’s own manual states that reverting to a previous software version is not possible, and warranty coverage is conditioned on accepting updates — so the owner cannot decline the channel through which the product is altered, audit what an update changed, or return to the prior state.S2S4

Voltage caps applied over the air to delivered Model S packs produced a judgment against Tesla in Norway’s Supreme Court in April 2026.S61 Purchased Autopilot was removed from a used car after Tesla’s own auction and restored only under press attention.S58 Salvage vehicles lose Supercharging and third-party fast charging irrevocably.S59 From late 2025, Autosteer hardware ships in every new US Model 3 and Model Y but requires the $99 monthly subscription to use.S81 The dependency reaches exit as well as use. FSD is non-transferable by default, with transfer permitted only through recurring time-limited windows conditioned on buying another TeslaS8; free unlimited Supercharging, sold as a benefit of the car, was made non-transferable and stripped from Tesla’s own used inventory.S113 What survives a change of owner is decided by Tesla rather than by the sale. None of this means title became a licence, and not every remote change is hostile: the same channel produced most of the value in the next section.

03 · The countercase, at full weight

The alignment record is not a footnote to the above. It is why the value score is 81.

The Supercharger network has ranked highest among DC fast-charging networks for five consecutive years, in a market where roughly one in five public charging visits ends with no charge delivered; opening the connector as SAE J3400 standardised rather than stranded owners’ investment.S44 Crash performance is validated by three independent regimes.S34S35

Two further counterweights belong in the judgment. No federal civil penalty or consent order against Tesla was located across 2012–2026, in a period when comparable manufacturers paid tens and hundreds of millions. And owners who experienced the flaws bought again: Tesla led Consumer Reports’ owner-satisfaction rankings from 2016 to 2020 and S&P Global Mobility’s brand-loyalty rankings from 2021 to 2023, before loyalty measurably declined in the wake of the resale-value damage.S53

04 · Tesla Energy

Smaller than the car business, and more hostile than it.

In April 2021 Tesla imposed increases of 30–150% on 8,636 signed Solar Roof contracts; more than 6,300 customers cancelled, and original prices were honoured only under litigation, settled without admission.S65S66 Permitted projects were cancelled en masse by form email in 2022, and Solar Roof was terminated in August 2026 with no published continuity plan for roughly 3,000 proprietary roofs.S67S68

Energy is genuinely aligned at the point of sale — the Powerwall warranty is industry-leading and virtual-power-plant programmes pay owners for the energy their batteries return — and misaligned across the twenty-to-twenty-five-year relationship that actually defines it.S11S70 Measured against the solar industry’s own low baseline, Tesla was cheaper than its peers and worse than baseline on the two acts that are specifically its own: repricing executed contracts, and abandoning customers mid-commitment when strategy changed. Its scale limits its weight in the company score. It does not remove it.

05 · Comparison

Tesla and Apple share a hostility score and almost nothing else.

Apple is CHI 68 / CVI 84 / CFS +16; Tesla is CHI 68 / CVI 81 / CFS +13. The identical hostility figure is a coincidence of arithmetic, not a statement of equivalence.

Apple’s hostility is metering, ecosystem control and exit friction, executed with disciplined representations: the company says what the product does, and the cost is that leaving becomes progressively more expensive. Tesla’s is promissory selling, remote control, remedy friction and risk transfer, executed over an unusually clean conventional extraction surface — no advertising in the product, no evidence of data sales, one posted national price. Different machinery, and different things for a customer to watch.

Tesla operates at least seven distinguishable customer relationships. In every one, Tesla controls more of the transaction, the product, the data, the remedy and the exit than any comparable company in its sector. Representation chronology

A decade of selling a capability, dated.

This is the central negative exhibit and it is stated with legal discipline. Tesla’s FSD conduct is not adjudicated fraud. One contested state administrative forum has found the marketing false and Tesla is litigating to erase that finding; a German appellate court ruled substantially for Tesla; two US juries returned defence verdicts. What is not in dispute is what was promised on dated pages, what was paid, what was delivered and when, and that no refund policy has ever existed.

The blog post declared every car in production carried the hardware needed for full self-driving “at a safety level substantially greater than that of a human driver.” The accompanying video opened: “The person in the driver’s seat is only there for legal reasons. He is not doing anything. The car is driving itself.”S1 Customers paid $5,000 for Enhanced Autopilot plus $3,000 for Full Self-Driving Capability at order.

In January 2023 deposition testimony, Tesla’s Autopilot software director testified that the video was staged: it used a pre-mapped route and did not reflect capability available to customers.S39 That testimony establishes the staging of that demonstration. It is not a general conclusion about every Tesla demonstration, and this page does not use it as one.

Statements made at Autonomy Day while FSD was on sale at $5,000–$7,000. The first supervised robotaxi pilot launched in June 2025 with roughly ten vehicles and a safety monitor in each. Targets stated for the end of 2025 — no monitors, 500 Austin vehicles, coverage of half the US population — were all missed; the February 2026 status was roughly 42 vehicles across two metropolitan areas.S106

Tesla promised free HW2 and HW2.5 to HW3 computer retrofits to FSD purchasers, and delivered them. This is the precedent against which the current HW3 position has to be read, and it belongs in the record at full weight.

Buyers who had already paid up to $10,000 were required to earn a Safety Score of roughly 98 to access the FSD Beta they owned.S7 The gate was removed at wide North American release in November 2022. Consumer Reports separately found that chasing the score could itself induce unsafe driving.

Refunds have been obtained only through individually fought arbitrations and small-claims actions — a Washington small-claims order in December 2022, an arbitration reimbursement in July 2025, a $10,000 court award in May 2026 that Tesla continued to contest.S89S87S88

An individually obtained remedy is not a companywide remedy. The distinction matters here more than anywhere else on the page: a customer who fought and won demonstrates that the claim had merit, and simultaneously demonstrates that no general remedy existed.

The HW3 admission.

On the fourth-quarter 2024 earnings call the chief executive stated that HW3 “does not have the capability,” promised free computer upgrades for FSD buyers, described the exercise as “painful and difficult,” and added that he was “kind of glad that not that many people bought the FSD package.”S77 Roughly four million vehicles carry HW3.

As of the 22 July 2026 earnings call there was still no programme, timeline or cost. Owners inquiring were told to be patient; a stripped “v14 Lite” build was shipped to HW3 cars as a software consolation; a trade-in discount path was floated without terms.S75S76 More than 3,000 HW3 owners across 29 countries have organised collective claims.

The California DMV finding — adopted, and contested.

The DMV adopted an administrative law judge’s decision that Tesla violated California law, that the “Autopilot” name was misleading, and that the “Full Self-Driving” representation was “actually, unambiguously false.” The offending claim quoted in the decision was that the system was “designed to be able to conduct short and long-distance trips with no action required by the person in the driver’s seat.” The remedy was a permanent stay of licence suspension conditioned on fixes, with 60 days to purge “Autopilot” from California marketing.S15S79

Tesla complied on 17 February 2026 and the DMV confirmed it.S16 On 13 February 2026 Tesla sued the DMV to reverse the finding.S78 The finding stands and is under challenge. It is a state administrative adjudication, not a fraud judgment, and this page does not describe it as one.

Counterarguments carried at full weight: FSD order pages have always carried a dependency disclaimer on regulatory approval; the feature was optional and most buyers declined it; partial capability was delivered continuously across the decade and the rename to “Full Self-Driving (Supervised)” in March 2024 was treated by the California regulator as partial mitigation. Software-defined ownership

The channel is dual-use. The hostility concentrates where Tesla’s interest and the owner’s diverge.

This section establishes the mechanism behind the new Digitally Contingent Ownership pattern. It does not claim Tesla converted legal title into a licence, that Tesla was definitively the first mass-market product with this architecture, that all functionality is revocable, or that software dependence necessarily produces net harm. It claims something narrower and better evidenced: that material properties of the car remain contingent on Tesla’s continuing permission, and that the owner holds no procedural rights inside that channel.

Hardware present, software withheld

Physically installed, software-disabled capability is a standing product architecture rather than an incident. Battery capacity has been software-locked since the Model S 40 and 60; acceleration has been sold as a $2,000 unlock; heated rear seats as a $300 unlock. From October 2025, Autosteer hardware ships in every new US Model 3 and Model Y while lane centering requires the $99 monthly subscription.S81 Disclosed in advance and priced accordingly, this is a legitimate commercial architecture. Its CHI relevance is what it demonstrates about where the product’s boundary actually sits.

Battery-gate: voltage caps applied to delivered cars, and seven years of litigation.

After a series of fires, Tesla applied over-the-air voltage caps to 2013–15 Model S packs. The change was not disclosed as a loss of range and charging speed. In the US the resulting class settled for $1.5 million, or $625 per owner, without admission.S63 In Norway the same conduct produced a judgment: on 23 April 2026 the Supreme Court rejected Tesla’s final appeal, leaving NOK 50,000 payable to each of 115 owners after a five-year, four-instance fight over claims worth roughly $4,600 each.S61S62

The same conduct produced a judicial finding in one jurisdiction and a $625 settlement in another. That cross-jurisdictional asymmetry is one of the most legible facts on this page.

Enhanced Autopilot and FSD, worth roughly $8,000, were remotely removed from a used Model S that had passed through a Tesla auction. Tesla’s explanation was that customers had been “incorrectly configured for Autopilot versions that they did not pay for.” The features were restored only after press coverage; no consolidated policy on what survives resale has ever been published.S58 A comparable case was reported the following month.

An internal policy memo established that vehicles marked salvage lose Supercharger access and third-party DC fast charging, with the memo recording that once a salvaged vehicle is listed as unsupported it cannot be changed.S59 A partial reinstatement path emerged in 2022; its pricing has never been published. The restriction applies whether or not the vehicle passes inspection.

A used Model S that had received a 90kWh warranty replacement pack years earlier was remotely re-locked by roughly 80 miles when it came in for a modem retrofit; Tesla demanded $4,500 to restore the capacity the owner had bought. The demand was reversed after the case went viral.S60

The recurring shape is the point: the remedy arrived because the case became public, not because a process existed.

What Tesla’s own documents say

The owner’s manual states plainly that “reverting to a previous software version is not possible.” Refusing updates can cost features, and the warranty provides that harm resulting from failure to install a software update is not covered.S2S3

The customer therefore cannot decline the channel through which the product is altered, cannot audit what an update changed, and cannot return to the prior state. There is no procedural right of any kind inside the mechanism.

Dashcam in 2018; Sentry Mode and Dog Mode in February 2019; Camp Mode; a blind-spot camera view; rear cross-traffic alert; a roughly 5% power increase pushed to 2019 Model 3s; annual holiday updates reaching decade-old cars. Most Teslas are more capable today than the day they were delivered — a post-purchase value stream no legacy manufacturer has matched.S2

The verdict is not that over-the-air control is hostile. Direct sales removed the dealer markup: through the 2021–22 shortage, buyers of competing electric vehicles paid $10,000–$30,000 over list while Tesla buyers never paid over list. The countercase is carried at full weight. No Tesla buyer has ever paid over list. The 2023 cuts were access-expanding and produced the cheapest real-terms Model Y ever sold. Tesla litigated for direct sales in Michigan, Texas and Missouri in a way that served customer access, and the FTC’s own economists have endorsed direct distribution as pro-consumer.S30 What CHI scores is not that prices moved — it is that customers carried all of the timing risk while Tesla retained all of the repricing freedom.

Ordering, delivery, cancellation and refunds

A durable system, not an occasional lapse

Quarter-end delivery pressure is corroborated by employees across years: the September 2019 “go all out” emails; VIN reassignment away from slow-closing custom orders in the second quarter of 2021; instructions to curtail delivery orientation; and advice to accept a car and schedule service later when defects were found at handover.S95S96S94 Multi-source recurring pattern

The order fee went from a refundable $1,000 to a non-refundable $100 to a non-refundable $250. The current agreement retains it as liquidated damages, caps Tesla’s total liability at reimbursement of the fee, and adds a 60-day mandatory pre-arbitration window.S5

Reservation-float products shift years of capital cost and price risk to customers: Roadster deposits of $50,000 have been held since 2017 with no cancellation control in the account, and a documented $5,000 retention was reversed only after publicity.S85 The Cybertruck took $100 deposits against a $39,900 announced price and launched at $60,990.S84

The countercase

A $250 order fee is small by industry standards, and the purchase itself remains one of the least extractive in car retail: no finance-and-insurance office, no dealer add-ons, no negotiation asymmetry, roughly ten minutes to buy a car.

The EU and UK order flows honour the statutory 14-day withdrawal right, and Tesla publishes the withdrawal instrument.S13 Korea’s competition regulator sanctioned the cancellation architecture in January 2023 with a fine and a corrective order, and the corrected terms Korean buyers received were never extended to US buyers.S99

Quality, service, warranty and remedy

Product failure improved. Remedy failure is what is scored.

CHI separates the two deliberately, and the distinction does decisive work here. Build quality followed a ramp-then-improve arc — near the bottom of Consumer Reports’ rankings in 2016 and 2021, then into the top ten of brands by the 2026 rankings, with the Model Y among the most reliable electric vehicles measured and the Cybertruck the clear outlier at ten recalls in 23 months.S52 The scored hostility is not that things broke. It is how Tesla adjudicated whether they had.

The touchscreen: a wear-out defect charged to owners until a regulator demanded otherwise.

An 8GB memory component with a finite write life was failing and taking safety-relevant functions with it. Owners were charged $2,500–$4,000 for replacements. Tesla’s VP of Legal wrote to the regulator that components “are not deemed defective if they fail due to age and wear.”S90 In February 2021, following a formal recall demand, Tesla recalled 135,000 vehicles and reimbursed prior payers.S17S91

A document-based investigation published in December 2023 described a February 2019 internal memo instructing staff to attribute suspension failures to “vehicle misuse,” against internal data showing known defects and four part redesigns; a China-only recall issued while Tesla told the US regulator no defect existed; and roughly 31,000 of some 120,000 control-arm replacements paid for by customers.S38 Tesla’s public rebuttal called the reporting “wildly misleading” while not disputing the repair volumes.S93

Discounted repairs were offered under agreements requiring customers not to discuss “the incidents or claims.” The federal regulator publicly called the practice troublesome; Tesla revised the language within days. In the same episode the chief executive publicly characterised suspension complainants as fraudulent.S40 Buyback agreements were later documented containing “no defect… purchased… under goodwill only” language alongside confidentiality — a remedy channel structured in a way that suppresses the defect signal.S92 The existence of that language is documented; its systematic use is an allegation and is not asserted here.

Service, parts and the channel

Structural friction

Vehicles per service location roughly quadrupled between 2016 and 2024. The app-only channel with no telephone path is a deliberate design choice, not a capacity accident; its consequences — estimate drift, no human escalation route — are recurring in owner evidence but cannot be quantified from it, and are not quantified here.

Battery service defaults to pack replacement rather than repair, documented in cases where a $16,000 quote was resolved by a $700 fix and a $22,500 quote by a $5,000 one.S104 The salvage and unsupported-vehicle policy functions as a structural deterrent to the third-party alternatives.

Lambrix v. Tesla, alleging parts and service monopolisation, survived dismissal in June 2024 with the court noting the tension between low-maintenance marketing and actual restrictions.S25 That is a pleading-stage ruling on plausibility, not proof on the merits. The FTC filed an amicus brief in the arbitration appeal.S26

A real convenience offset

The lowest ten-year maintenance and repair cost of any brand in Consumer Reports’ member data — $4,035, against $4,900 for the next-cheapest brands — on a 75th-percentile projection across 2014–2023 model years.S45 There is no scheduled maintenance regime at all, and no dealer service-upsell channel exists.

Between 30% and 50% of service visits are handled by mobile technicians who come to the car, supported by a fleet of more than 1,900 vans. Over-the-air recall remedies complete at rates the rest of the industry cannot approach.S22

Service manuals were made free in 2022, ahead of several legacy manufacturers.S105 The 2018–19 collision-parts crisis, with documented four-to-six-month waits, drove Tesla to build its own collision network — a self-created problem partially self-remedied.

Range, battery and charging

The sharpest split in the company.

Nowhere else does Tesla’s record contain both its worst-documented conduct and its single best customer asset within one subject.

The range record

Tesla systematically selected the EPA methodology option that maximised the label figure, including a documented refiling of identical 2017 test data at a higher adjustment factor.S48S33 All eight Teslas tested by Edmunds missed their EPA figure while nearly all non-Teslas met theirs; Tesla’s rebuttal was that testers should have driven past indicated zero into the buffer.S42S43

The July 2023 investigation documented complaint suppression as process: a team created in Las Vegas to cancel range-complaint service appointments, closing cases by the hundreds each week, diagnostics stopped on the reasoning that no fix existed, and the app altered so that range complainants could no longer book service.S37 Tesla never responded publicly. The Department of Justice subpoenaed vehicle-range information, disclosed in Tesla’s own filings; there is no public disposition. The class action was compelled to arbitration.S86 Korea’s competition regulator issued the only monetary penalty, over undisclosed cold-weather range loss.S98

The January 2024 label reductions across the lineup came when an EPA rule change forced them, not before.S100 A May 2017 silent throttling of Supercharging rates on high-use packs, admitted only after owners detected it, belongs to the same family: purchased capability quietly curtailed.S64

The charging and battery record

The Supercharger network has ranked highest among DC fast-charging networks in J.D. Power’s study for five consecutive years — 739 against a segment average of 654 in 2023, and 709 against 591 in 2025 — in a market where roughly one in five public charging visits ends without a charge delivered, overwhelmingly through station outages.S44 Plug-and-charge and route integration remove the friction that defines the rest of the category. Opening the connector, standardised as SAE J3400, protected rather than stranded owners’ charging investment.

Winter range retention is best in class by independent telemetry across roughly 30,000 vehicles, with heat-pump Teslas at the top of the retention table.S49 Battery degradation of roughly 12–15% at 200,000 miles is corroborated independently.

Two honest qualifications. Uptime is self-defined — a site counts as up when at least half its stalls work. And in April 2024 the entire charging organisation of roughly 500 people was dismissed in one decision; contractors were told to hold off breaking ground on newly awarded projects, utility partners were blindsided mid-project, and new port deployment ran far below plan before partial rehiring.S114

The 2024 firing is included under this page’s entity rule because it was a Tesla decision that directly and measurably affected the Tesla customer proposition. It is not included as commentary on the person who made it. The finding it supports is institutional: the strongest customer-alignment asset in the CHI corpus has no structural protection from a single unilateral decision.

Privacy, data and insurance

A representation gap, and a conflict made operational.

The camera record

Tesla’s privacy notice states that camera recordings “remain anonymous and are not linked to you or your vehicle.”S9 An April 2023 investigation documented employees sharing customers’ intimate camera footage through internal chat between 2019 and 2022, with the labelling tool displaying recording locations.S36 Tesla never responded publicly. The victims’ class was compelled to arbitration in October 2023, an order that bound a non-signatory child through equitable estoppel.S24 Two US senators wrote to Tesla about the practice.S31 The incidence of the sharing cannot be established from the available evidence and is not quantified here.

Who holds the evidence

Selective release, two continents

In 2018 the US National Transportation Safety Board revoked Tesla’s party status to an investigation after Tesla publicly released data attributing a fatal crash to the driver while the investigation was live.

In China, Tesla released identifying crash data about a complaining owner to media, won defamation damages against her, and was then ordered by a court in September 2025 to hand over the brake-pedal data it had withheld for four years.S101

The Netherlands Forensic Institute reverse-engineered Tesla logs in 2021 and found the vehicles store far more data, for far longer, than Tesla was supplying to investigators — Tesla provides what is specifically requested, and, as the institute put it, you cannot claim what you do not know.S102

An internal directive documented in the May 2023 leak instructed staff to communicate about acceleration and braking complaints verbally, leaving no written record.S41 No law-enforcement transparency report exists.

The peer-relative countercase

No evidence has been located that Tesla has ever sold customer data. The first US enforcement action over connected-car data went to a different manufacturer and a data broker, not to Tesla.S29

In-car privacy controls are real and granular, and camera data sharing requires opt-in consent. Tesla Energy is assessed as a distinct customer system inside the Tesla profile. It is smaller than the car business and, on contract stability, service continuity, strategic abandonment and long-term remedy, more hostile than it. Its smaller scale limits its weight in the consolidated company score. It does not permit the automotive customer value to conceal it.

Tesla imposed increases on 8,636 signed Solar Roof contracts. More than 6,300 customers cancelled. The Powerwall 2 warranty guarantees 70% capacity at ten years with unlimited cycles when used for solar self-consumption or backup — genuinely industry-leading terms.S11 Its one hostile clause is that full coverage depends on the unit remaining connected and registered, which shifts a telemetry obligation onto the customer.

Tesla’s virtual power plants pay owners for the energy their batteries return, with Californian participants earning roughly $500 in the first year.S70S12 That rate is utility-funded rather than Tesla generosity, but the mechanism genuinely monetises a customer asset under the customer’s own control. Price leadership between 2019 and 2022 was real, deposits are refunded in full on cancellation, and the relaunched lease from October 2025 offers $600 down with an availability guarantee — alongside a 3% annual escalator of the kind criticised in the SolarCity era.S69

Apple’s higher CVI at 84 and higher CFS at +16 also matter: Apple delivers slightly more, on this methodology, and nets out further ahead. The pages are neither morally nor methodologically equivalent, and the near-identical CHI figures should not be read as saying they are.

What a customer should actually watch

With Apple: the accumulating cost of leaving. The risk is gradual and mostly visible on a price list.

With Tesla: the gap between what is represented and what is scheduled, and the terms-page surface. Tesla’s most consequential changes have repeatedly arrived as silent edits to published terms — a deleted return page, a doubled fee, a contracted warranty — rather than as announcements. That surface is monitorable, and it is where this assessment found most of its evidence.
